These Terms apply to candidates and employers using WellDesty’s recruitment and manpower supply services. By submitting information, requesting recruitment assistance, or engaging WellDesty, you agree to these Terms and the applicable job-specific documents provided to you.
1. WellDesty’s role and recruitment approach
WellDesty aims to make recruitment clear, documented, and fair for both candidates and employers. Our process is designed to address common problems faced by blue-collar job seekers, including misleading vacancies and recruitment fraud.
For each vacancy, we aim to:
- Obtain and review the employer’s hiring requirements and available vacancy information.
- Make reasonable checks on the employer, vacancy, job location, and proposed terms, including requesting relevant authorisations or recruitment documents where applicable.
- Screen candidates against the vacancy’s stated skills, experience, eligibility, and document requirements.
- Share candidates with the employer only when they appear eligible for that particular role based on the information and documents available.
- Coordinate interviews, assessments, and job-related medical checks where required.
- Communicate selection decisions and provide the available written job terms and next steps.
- Assist with applicable documentation, visa or emigration processing, and travel coordination within the scope agreed for the vacancy.
Our aim is to present candidates who meet the stated requirements and work with employers whose legitimacy has been reasonably checked. Screening and verification reduce risk but cannot establish an absolute guarantee about another person, company, document, decision, or future event. Employers make hiring decisions, and government authorities make visa and emigration decisions.
2. Candidate responsibilities
Candidates must:
- Provide accurate, complete, current, and genuine résumés, certificates, identity documents, employment records, and other requested information.
- Attend interviews, assessments, and required medical appointments on time and follow the relevant instructions.
- Read and understand the written job offer and employment contract before accepting.
- Tell WellDesty promptly about any change to their availability, qualifications, contact details, or eligibility.
- Keep copies of their passport, receipts, job offer, employment contract, and other important records.
- Avoid signing blank documents or making payments without a written explanation and receipt.
If a candidate submits a forged, altered, misleading, or duplicate document, WellDesty may pause or end the application, notify the employer or relevant authority where appropriate and lawful, and take other steps permitted by law. WellDesty cannot certify a document that it has not independently verified.
3. Employer responsibilities
Employers must provide accurate vacancy details, including the job title, duties, location, required qualifications, wages, working hours, benefits, accommodation or transport arrangements where applicable, contract duration, and any candidate-paid or employer-paid costs.
Employers are responsible for:
- Confirming that the vacancy exists and that they have authority to hire.
- Providing accurate and lawful job terms and required recruitment documents.
- Making selection decisions fairly and communicating them promptly.
- Providing the candidate with the applicable written employment contract and explaining any material changes before acceptance.
- Meeting their own obligations concerning wages, working conditions, permits, worker protection, and applicable local law.
WellDesty may decline or suspend a vacancy if its details cannot be reasonably verified or appear misleading, unlawful, or materially incomplete.
4. Selection, medical checks, visas, and travel
WellDesty will make reasonable efforts to support timely progress and keep the parties informed. However, interviews, selection, medical outcomes, visa issuance, emigration clearance, flight availability, and joining dates may depend on employers, clinics, government authorities, airlines, or other third parties. No selection, visa, travel date, or employment outcome is guaranteed.
A candidate should not resign from existing work, borrow money, or make non-refundable travel arrangements based only on verbal statements or an interview invitation. The candidate should rely on the final written offer, contract, and official travel or visa documents.
5. Passports and original documents
A passport belongs to its holder. WellDesty will request temporary submission of a passport only after reasonable job and employer checks and only where the document is necessary for a disclosed, lawful processing step.
Where WellDesty receives an original document, it will acknowledge receipt and handle it securely. The usual target for temporary passport handling is up to 30 days. In some cases, processing may exceptionally take up to 90 days because of employer, visa, or authority requirements. WellDesty will explain the reason and provide updates. Any handling or retention is subject to applicable law; these Terms do not give WellDesty an unrestricted right to keep a passport.
6. Fees and payment terms
Fees, the party responsible for each fee, payment milestones, refund terms, and any third-party costs must be disclosed in writing for the relevant vacancy before payment is requested. The payment cycle may vary by vacancy and employer policy, but it must be communicated clearly and must comply with applicable law.
Candidates should pay only against a written demand and obtain a receipt. No fee is payable to an individual’s personal account unless the written fee document specifically identifies that arrangement and it is lawful. Overseas recruitment charges are subject to applicable rules and limits. Candidates and employers should verify the requirements current on the relevant recruitment date through the Ministry of External Affairs’ Emigration Abroad for Employment guidance.
7. Documents and responsibility for losses
Each party is responsible for the accuracy and authenticity of the information and documents it supplies. If a party knowingly provides forged, altered, duplicate, or materially false information, WellDesty may suspend the process and may notify affected parties or authorities where appropriate and lawful.
WellDesty is not responsible for losses caused by a party’s false information, an employer’s or candidate’s independent actions, or a third party’s decision or delay, except to the extent the loss results from WellDesty’s own breach of law, negligence, or other liability that cannot lawfully be excluded. Nothing in these Terms removes rights or protections that cannot be waived under applicable law.
8. Complaints and disputes
Please raise concerns promptly using the contact details below and include the vacancy reference, relevant dates, and supporting documents. WellDesty will acknowledge the complaint and make reasonable efforts to review it.
These Terms are governed by the laws of India, together with any mandatory laws or dispute procedures that apply to the candidate, employer, recruitment process, or destination country. Jurisdiction and the appropriate court or dispute forum will be determined under applicable law.
9. Changes and contact
We may update these Terms by publishing a revised version with a new effective date. For questions about these Terms or WellDesty’s services, contact the WellDesty team:
